Lex Capital at the conference on Third-Party Litigation Funding in Milan

18 October 2024 by gianfranco.ciuffreda Leave a Comment

Convegno-Third-Litigation-Funding-980x735

On 16 October, the prestigious conference on third-party litigation funding in Italy was held at the Palazzo Giurenconsulti in Milan, and LexCapital took part with great enthusiasm.

With a long-standing commitment to the field of legal litigation, LexCapital brought its expertise to the conference alongside leading industry experts, legal professionals and prominent financiers.

The conference aimed to provide an examination of the evolution, opportunities and challenges, operational models and procedural aspects of a tool – litigation funding – that is revolutionising the traditional structure of the justice system, presenting itself as a tool with multiple advantages, chief among them ensuring fairer access to justice and allowing those who assign their litigation rights to protect their rights, without financial risk or commitment, both in the pre-litigation and litigation phases.

Below are the main presentations that featured at the conference, organised by RPLT Law Firm and, as media partner, Italia Oggi.

Why a conference on Third-Party Litigation Funding?

The conference was designed as an opportunity to discuss the experiences and opportunities, within the Italian context, of a complex and sophisticated tool such as litigation funding, in the presence of various experts.

Long established in the Anglo-Saxon world, litigation funding as a tool for resolving legal disputes is also gaining ground in Italy, thanks to the contribution of organisations such as LexCapital, which have decided to use it to facilitate access to litigation.

For a long time, its spread in Italy has been hindered by certain regulatory and legislative aspects, as well as the difficulties, inefficiencies and lengthy delays of the Italian justice system.

The conference presentations focused on specific thematic areas, which highlight some key prerequisites for the use of litigation funding:

  • organised data management;
  • accurate assessment of litigation costs;
  • measurement of litigation risk;
  • the various types of contracts.

Conference on Third-Party Litigation Funding: the speakers

During the conference, a number of experts took the floor to share their professional expertise and experience. In particular, during the first panel discussion, which focused on the opportunities and operational aspects of litigation funding in Italy and was expertly moderated by Paolo Grandi, the following speakers took the floor:

Dr Andrea Giovannetti, founder and Chairman of CFO Solutions SCF s.r.l., spoke on the efficient management of data and information, stating that “without the organisation of data, analysis is impossible, and it is precisely this activity that makes the difference in the accurate assessment of a dispute”;
Mr Giovanni Barone, Legal Director at Coca-Cola Europacifics Partners, spoke on the subject of costs, highlighting the positive impact of litigation funding on the cash flow of litigation;
a topic of central importance was discussed by Amedeo della Croce, regarding a possible convergence between legal and economic aspects in the Litigation Funding instrument, emphasising the support offered by Litigation Funders in the management and verification of documents relating to litigation.

The presentations during the conference’s second panel were devoted to the contractual aspects of litigation funding, an engaging round-table discussion skilfully moderated by Luitgard Spogler, featuring experts such as Francesco Ghizzi, Ursula Claravolo, Niccolò Landi, and Alberto Odennino, who provided a detailed analysis of the models and types of policies and services currently available, presenting a number of practical case studies.

Finally, the third panel, skilfully moderated by Nicolò Manzini, focused on the similarities and differences between class actions and litigation funding.

Speakers on the topic included Mr Paolo Florio (Movimento Consumatori), Mr Francesco Marelli (RP Legal & Taxi) and Mr Giovanni Latorre (Chief Legal Officer at LexCapital), who discussed the models for class actions and their potential integration with supporting instruments that have long been present in foreign markets, such as Litigation Funding.

The event served as an important forum for discussion on a new and complex topic such as litigation funding and, more generally, on methods of managing litigation risk, enabling LexCapital to offer a unique perspective and concrete insights on this subject, which is currently undergoing significant adaptation and evolution within the Italian context.

Webinar on corrugated cardboard purchases: how to claim compensation

22 April 2024 by Damiano Meta Leave a Comment

Il-cartello-del-cartone-ondulato-2-1080x675.jpeg

If you purchased corrugated cardboard between the years 2004 and 2017, you have likely incurred financial damage for which you have the right to claim compensation. In the next free Webinar, Lex Capital, with a view to spreading awareness of litigation funding, in collaboration with its partner IsMy, will offer all the information you need regarding antitrust and corrugated cardboard. The event will take place on May 8, 2024, at 11:30 AM. To participate, please connect to this link.

Webinar on corrugated cardboard purchases: the problem of litigation

The unfair practices carried out for over a decade by the cartel have caused difficulties for those who purchased corrugated cardboard packaging and sheets between the years 2004 and 2017, giving them the possibility to request financial reimbursement. Perhaps you would like to request a refund; however, you might be intimidated by the high costs expected from the proceedings. Lex Capital is a company actively involved precisely in the purchase of litigious rights: it will bear all the burdens for legal expenses and technical consultancies. A pre-agreed share, commensurate with the financial benefit, will be collected in the event of a successful outcome, while nothing will be owed to Lex Capital in case of an unsuccessful outcome.

Topics covered in the webinar

During the webinar, all the necessary topics to navigate the compensation claim process will be addressed.

  • Summary of the affair: the effects of the investigation completed by the Italian Competition Authority (AGCM).

  • Requirements to obtain a refund and eligible subjects: types of purchases and reference years of the purchases.

  • Financial and management support from Lex Capital: support and benefits for companies.

Participation in the webinar is free of charge. You can write to jaime.contu@ismysrl.com for any information regarding the event.

A litigation fund

11 April 2024 by Damiano Meta Leave a Comment

Articolo-Report-AO-060424-MilanoFinanza.jpg

In Italy, the instrument of Litigation Funding is becoming increasingly widespread. This involves an entity, typically a Special Purpose Vehicle (SPV) or a Fund, that approaches the holder of a litigation right to support them in protecting their rights by bearing all expenses, including those due in the event of an unsuccessful outcome, or by making a purchase proposal.

This is also evident from the latest Global Antitrust Enforcement Report by Allen & Overy, which specifically records an increase in private enforcement actions within our territory. The article in Milano Finanza, in which we are cited, makes particular reference to actions for damages brought against banking institutions for the alleged manipulation of Euribor rates, but above all, to the agreement among corrugated cardboard manufacturers, which it describes as "...one of the largest cartels ever uncovered in Italy by the Antitrust Authority due to the number of companies involved (34) and the scale of the fines imposed."

We take this opportunity to remind you that LexCapital, in its capacity as a Litigation Funder, is actively collecting reports concerning the corrugated cardboard cartel up until May 31, 2024, which is the final deadline for accepting them.

LexCapital announces the addition of Lucca to its shareholders. Luciano Lucca will be the new Chairman of the BoD.

7 March 2024 by Damiano Meta Leave a Comment

LexCapital announces the addition of Lucca to its shareholders. Luciano Lucca will be the new Chairman of the BoD.

  • Elisabetta Vasco, former manager of Intesa Sanpaolo and Ubi Banca will also be joining LexCapital’s BoD.
  • The board also confirms the addition of Marcello Gallo, Emilio Campanile and Maurizio Santacroce. Giuseppe Farchione remains in post as Chief Operating Officer.
  • With the addition of Lucca’s, LexCapital hopes to continue its growth in the field of Predictive Justice

Milan, 1 February 2024 – LexCapital, an innovative legal-tech start-up and benefit corporation operating as a litigation funder, announces the addition to the company of Lucca’s S.r.l., a holding company owned by the family of entrepreneur Luciano Lucca, founder and chairman of the Assiteca Group, a leading player in the insurance brokerage sector.

The new BoD of LexCapital with Luciano Lucca and Elisabetta Vasco

Lucca also took on the role of Chairman of LexCapital’s Board of Directors, which was enlarged from three to five members, with the addition of Elisabetta Vasco (independent), previously a senior manager of Banca Intesa Sanpaolo and of Ubi Banca. Marcello Gallo, Emilio Campanile and Maurizio Santacroce remain in post as Directors. Giuseppe Farchione remains in post as Chief Operating Officer.

Luciano Lucca started his career in the insurance sector in 1966 at Toro Assicurazioni before founding Verconsult, an insurance brokerage company, in 1972, and becoming its Managing Director. Following Verconsult’s move to the GPA group in 1975, Lucca took on prominent roles in GPA and in its subsidiary SAMA. His career underwent a further transformation in 1982 with the founding of HOWDEN ASSITECA, of which he became Managing Director and, subsequently, Chairman. In 2005, he was appointed Vice-President of the National Association of Insurance Brokers (ACB) and in 2010 he took over the presidency of EOS RISK España, one of the leading insurance brokerage companies in Spain.

Predictive Justice and Litigation Funding: the future of the start-up

According to LexCapital’s COO Giuseppe Farchione, “the new additions confirm the growth trajectory of LexCapital’s original project. The heart of the project remains our technology platform, LexCapital Litigation Assessment – LLA, in the field of Predictive Justice. An innovative tool, based on a statistical-mathematical model, which allows the investment opportunity to be assessed in advance, taking into account various parameters such as the defendant’s solvency, the probability of a favourable outcome and an estimate of the possible proceeds. It is an area that has enormous potential for development thanks to artificial intelligence. In the near future, we will also make our platform available to third parties such as law firms, auditing firms, management consultancies, banks and insurance companies. We know how costly and complex litigation can be in Italy: our Predictive Justice technology, designed to support and guide decisions, helps to minimise the risk of losing a case and the relative consequences”.

Luciano Lucca, Chairman of LexCapital’s Board of Directors, says he became “interested in the LexCapital project owing to its innovation and cutting edge technology. I am convinced that the concept of predictive justice in support of litigation funding will be of central importance in the future.”

LexCapital’s experience

In its first eighteen months of operations, LexCapital has already assisted its client companies in litigation in the antitrust sector and has a substantial number of cases in the pipeline in other areas, such as reservations in public works, medical and professional damages and financial derivatives contracts.

All of which is done through litigation funding, an operation whereby a third party buys the chose in action and makes its financial resources and network of lawyers and specialist consultants available to those who wish to defend their rights in court, sharing in any proceeds and assuming all the financial risks.

The company has also initiated a pilot case comprising approximately fifty disputes in the Reverse Litigation Funding or Defence Side Litigation Funding segment on behalf of a leading insurance company.  A service that could be replicated and distributed throughout the same market to support other companies. The official announcement of a new partnership between independent national litigation funders, with LexCapital as promoter and co-founder, who will cooperate on cross-border projects and with regard to co-investment in larger litigation matters, is expected soon.

The legal teams

The Deloitte Legal team, composed of the lawyers Alessandra Gesino and Sandro Lamparelli, assisted Lucca’s S.r.l. in carrying out the due diligence and in negotiating the terms of the agreement to acquire an interest in and serve on the Board of LexCapital. The company’s in-house team, assisted by the lawyer Paolo Grandi from Studio RP Legalitax, directly handled the activities related to the agreement.

Legal Tech Forum 2023 in Bologna: LexCapital as a Gold Sponsor

6 October 2023 by Damiano Meta Leave a Comment

Legal-Tech-Forum-2023-954x675.jpg

LexCapital participated as a Gold Sponsor at the Legal Tech Forum 2023.

The Forum, which took place in Bologna on 29 November at the Cappella Farnese di Palazzo D’Accursio, is considered a leading light in the debate on technology in the legal world.

It focused in particular on the synergy between the law and technology.

LexCapital’s CIO Manuel Caccone gave a talk which focused in particular on the topic of “Litigation Funding and Predictive Justice“.

Legal Tech Forum 2023 in Bologna: an important conference on legal technologies

The event was promoted and coordinated by Legal Tech Italy.

An observatory – founded by the Bologna-based company Kopjira – which has been studying the legal-tech sector for many years and is concerned specifically with the interaction between the law and the numerous possibilities offered by new technologies.

Since 2015, Legal Tech Forum has been an unmissable event for those wishing to discuss developments in technology in the legal field.

A discussion which sees the active participation of influential guests – companies, start-ups, law firms and industry professionals – who bring their field experience and encourage debate on this cross-sectoral issue.

To date, the event has welcomed 2500 participants and more than 150 speakers, who have been invited to discuss how the spheres of law and new technologies can be combined.

The historic guests of Forum 2023

Now in its seventh year, the Legal Tech Forum has seen the participation of renowned speakers and leading companies over time.

Among these companies were Sky, Google, Mediaset, IBM and Cisco.

The event, after two years of being held remotely, was back open to visitors attending in person.

This decision was taken not only in order to appreciate the physical spaces symbolising the birth of the project, but also to encourage direct (in person) debate between the various professionals in the sector.

Many topics were discussed: Big Data, Cybersecurity, Metaverse, Blockchain and, of course, the new frontier of artificial intelligence, with its legal and regulatory aspects, and Predictive Justice.

The debate on legal technologies

The debate surrounding legal technologies is not merely technical, but also involves questions of ethics and morality.

As Tommaso Grotto – CEO and co-founder of Kopjira – pointed out, we are living in a historic time in which our interaction with new technologies is becoming more and more widespread and intrusive in every sector.

This leads to questions regarding the functional aspect of these tools – their correct use – and also regarding the related ethical and social issues.

Legal Tech Forum aspires to become the epicentre of debate on this issue and LexCapital is delighted to have been able to contribute its experience, professionalism, and vision.

Participation of LexCapital in the Conference on Sustaining Access to Justice in Europe: a significant event with regard to the topic of Access to Justice

29 September 2023 by Damiano Meta Leave a Comment

Conference-Sustaining-Access-to-Justice-in-Europe.jpeg

LexCapitalis proud to have participated, as a speaker at the Conference on  Sustaining Access to Justice in Europe, held on 19 – 20 October.

Organised by the Erasmus University Rotterdam, and in particular by the NWO team of the Vici Project Access to Justice, the event is one of the most interesting, internationally, on the topic of access to justice.

Key figures from the worlds of politics, academia and business, together with consumer associations from Europe, the USA and Asia, discussed problems and developments concerning access to justice in Europe.

In particular, how it is facilitated by new forms of litigation funding.

Conference on Sustaining Access to Justice in Europe: the event

The event, held in the form of a symposium, was attended by influential figures from civil society and the intellectual world, also dedicated to exploring new forms of litigation funding.

Particular attention was paid to forms such as Crowdfunding, third-party support in litigation (Litigation Funding) and Class Actions.

The main topic of debate?

Improving the mechanisms for access to civil justice, with the aim of making the process smoother and fairer.

Our COO, Giuseppe Farchione, took part in the panel “Altruistic Ventures: Balance, Profitability and Social Impact – Myth or Reality”, to discuss the right balance to be pursued, also in Litigation Funding, between profitability and a positive social impact, in parallel with traditional “for profit” activities.

The basic question is whether litigation driven by fair and altruistic goals, in today’s society, is a fact or mere utopia.

Access to Justice in Europe

The topic of facilitating Access to Justice in Europe is widely debated.

Access to the court system, without particular obstacles and limitations, is the only avenue open to citizens wishing to assert their rights.

However, in Europe, government cutbacks and the exorbitant costs of court proceedings have made access to certain avenues of justice increasingly unequal.

In this context, financial (and organisational) support has shifted from the public to the private sphere, making it possible for companies and citizens to seek support from third parties, through Social Impact Litigation Funding.

LexCapital, which, since its recent launch, has been dedicated to improving the justice mechanism through its Litigation Funding activity, was delighted to bring its experience to the Conference on Sustaining Access to Justice in Europe.

At the event, we focused in particular on two aspects: Civil Rights and Litigation Funding and Support for Non-Profit Organisations by Litigation Funders.

The cover image is taken directly from the conference announcement page of the Erasmus University Rotterdam website.

Local authorities: zero-cost justice without burdening taxpayers thanks to “litigation funding”. ASMEL and LexCapital sign an agreement that will enable Italian town councils to assert their rights without cost or risk and assisted by experts

9 May 2023 by Damiano Meta Leave a Comment

litigation-found-Lex-Capital-1080x675.jpg

Lack of economic resources and specific technical expertise prevent many town councils in Italy
from protecting their interests in court, especially in relation to well-established organisations such as large companies
and banking and insurance intermediaries: at risk are the rights and budgets of local authorities and consequently
the financial well-being of citizens.
Thanks to the agreement between ASMEL and LexCapital, the more than 4,000 town councils forming part of ASMEL
will be able to reduce their legal costs by ceding to LexCapital the chose in action for disputes in which they are a plaintiff and, in some
cases, where they are a defendant.
LexCapital will sue in place of the town council, which will pay
no charge for the service obtained.
In the event of victory, most of the proceeds will go to the town council and only the remainder will go to LexCapital.

Milan, xx 2023 – Local authorities are more efficient and able to safeguard legality and enforce their rights at zero cost thanks to litigation funding. It is estimated that legal costs incurred by local authorities and the government cost on average €410,000 per authority ¹. This significant sum, however, does not tell the whole story. Every year, many town councils, particularly the smaller ones, forgo taking legal action, especially against large companies and financial and insurance intermediaries due to a lack of funds or the necessary technical expertise. This has major repercussions for budgets and taxpayers’ pockets. To remedy the problem, ASMEL, Association for the Subsidiarity and Modernisation of Local Authorities, has signed an agreement with LexCapital, an innovative start-up and Benefit Corporation operating as a litigation funder, which will allow the more than 4,000 associated local administrations to protect their rights at zero cost with a high probability of victory, supported by a team of experts.

How? Through litigation funding, which allows
a third party, in this case LexCapital itself, to acquire the chose in action, acting in
the proceedings in place of the local authority and providing financial resources as well as technical and
legal expertise. The agreement covers disputes in which the authority is a plaintiff
and, in some cases, also those in which it is a defendant. Thus, the local authority will be able to notably reduce
its expenditure on legal fees and contingencies and will be able to rely on the experts at LexCapital
(lawyers, accountants, economists, engineers, IT professionals and other expert
litigation professionals) who will take charge of the disputes. In the event of a successful outcome, after deducting the costs incurred,
LexCapital will receive only a portion of the proceeds, while the local authority will collect the larger share.

What types of disputes may be of interest? ASMEL and LexCapital have already identified some matters
that could be of interest to local authorities, owing to the potential financial and economic benefits they could
obtain. These include: bonds, credit facilities, loan agreements in effect or
expired, reservations in public works contracts with the potential for counterclaims, planning agreements concluded with private enterprises that have not fulfilled their part of the obligations
undertaken. The service also covers financial derivatives, high-risk investment instruments that have been declared null and void since
2020 following a landmark ruling by the Cassation Court, but which still have a significant impact on budgets and have given rise to many disputes between local authorities and banks.

¹ Sources: Scientific note of the Demoskopika Institute “Liti e contenziosi. La mappa degli esborsi della Pubblica Amministrazione italiana”. The period examined is between 2010 and February 2017.

“Every time a local authority fails to defend itself in court, it is the entire community that loses. Sometimes, initiating litigation can be too costly and complex, especially if there are large companies and banking and insurance intermediaries on the other side” commented Giuseppe Farchione, Chief Operating Officer at LexCapital. The agreement with ASMEL will allow us to offer its members free technical and legal support through litigation funding, which is already in vogue in the United States and has recently arrived also in Europe. Thanks to this service, local authorities will be able to use their resources more efficiently, without embarking on long, costly and unpredictable proceedings and, above all, without threatening the sustainability of their budgets or burdening taxpayers. We at LexCapital will act in their place, providing expertise and experience, and also assuming the risk and costs associated with a possible loss. A significant contribution, of which we are proud, to the efficiency of local authorities and to legal certainty.

Asmel

Established in Gallarate (VA) in May 2010, today its membership comprises 4135 associated local authorities. In addition to the institutional representation of the local authorities in all the designated locations, the Association promotes the digitalisation and simplification of procedures through the associated network management of municipal services. This is an alternative to the associated management of functions that the central apparatus and other associations seek to impose on town councils as the “definitive solution” for the purposes of the “spending review” and the “zeroing” of smaller councils. ASMEL’s action is based on the principles of subsidiarity in order to effectively safeguard the constitutionally guaranteed autonomy of town councils,
and has led to the involvement of several communities in the associated management of municipal services.
These include the continuous training of employees and local administrators, fulfilling formalities related to privacy, anti-corruption, planning, etc., as well as digitalisation and environmental transition, public procurement and recruitment and competitions.

LexCapital

Set up in 2021, LexCapital is an innovative start-up and benefit corporation that operates as a litigation funder, which aims to become the leading litigation funder in Italy. It evaluates, acquires and manages the chose in action (having a financial value and solvent defendants) from parties holding said rights: companies, public bodies, individuals, non-profit organisations, assuming the relative risks and costs and with the aim of making justice more accessible to all. The process of selecting and evaluating cases to be acquired is done through the company’s proprietary technology platform: LexCapital Litigation Assessment (LLA). It operates mainly in the areas of commercial law (breach of contract, harmful products), corporate law (antitrust, intellectual property/patents/trademarks, reservations in public works, compound interest and financial law, revocatory actions), bankruptcy and class actions. LexCapital was founded by a group of entrepreneurs and professionals working in the finance and legal sectors: Emilio Campanile (Presidente), Marcello Gallo and Maurizio Santacroce are the company’s directors. The management team is steered by Giuseppe Farchione (COO and CFO).
