LexCapital in Diritto Bancario magazine: third-party litigation funding

LexCapital is featured in the magazine Diritto Bancario in an article that analyzes in detail the characteristics of so-called Third-Party Litigation Funding—namely, the financing of legal expenses by a third party aiming to obtain a fee in the event of a victory for the funded party—focusing on the risks and opportunities of such operations.

In addition to explaining what it is, the article highlights the benefits of using this tool, which is still little known on the Italian market and stands midway between the legal and financial worlds, specifying that it can be used both on the Plaintiff's side (classic Litigation Funding) and on the Defendant's side (Defense-side Litigation or Reverse Litigation Funding).

LexCapital in defense of the market: the copper cable cartel

The Italian Competition and Market Authority (AGCM) announced, in a press release dated 12 December 2024, that it had launched an investigation into an alleged cartel in the copper cable manufacturing sector, dating back to 2005.

On 16 October, the prestigious conference on third-party litigation funding in Italy was held at the Palazzo Giurenconsulti in Milan, and LexCapital took part with great enthusiasm.

With a long-standing commitment to the field of legal litigation, LexCapital brought its expertise to the conference alongside leading industry experts, legal professionals and prominent financiers.

The conference aimed to provide an examination of the evolution, opportunities and challenges, operational models and procedural aspects of a tool – litigation funding – that is revolutionising the traditional structure of the justice system, presenting itself as a tool with multiple advantages, chief among them ensuring fairer access to justice and allowing those who assign their litigation rights to protect their rights, without financial risk or commitment, both in the pre-litigation and litigation phases.

Below are the main presentations that featured at the conference, organised by RPLT Law Firm and, as media partner, Italia Oggi.

Why a conference on Third-Party Litigation Funding?

The conference was designed as an opportunity to discuss the experiences and opportunities, within the Italian context, of a complex and sophisticated tool such as litigation funding, in the presence of various experts.

Long established in the Anglo-Saxon world, litigation funding as a tool for resolving legal disputes is also gaining ground in Italy, thanks to the contribution of organisations such as LexCapital, which have decided to use it to facilitate access to litigation.

For a long time, its spread in Italy has been hindered by certain regulatory and legislative aspects, as well as the difficulties, inefficiencies and lengthy delays of the Italian justice system.

The conference presentations focused on specific thematic areas, which highlight some key prerequisites for the use of litigation funding:

  • organised data management;
  • accurate assessment of litigation costs;
  • measurement of litigation risk;
  • the various types of contracts.

Conference on Third-Party Litigation Funding: the speakers

During the conference, a number of experts took the floor to share their professional expertise and experience. In particular, during the first panel discussion, which focused on the opportunities and operational aspects of litigation funding in Italy and was expertly moderated by Paolo Grandi, the following speakers took the floor:

Dr Andrea Giovannetti, founder and Chairman of CFO Solutions SCF s.r.l., spoke on the efficient management of data and information, stating that “without the organisation of data, analysis is impossible, and it is precisely this activity that makes the difference in the accurate assessment of a dispute”;
Mr Giovanni Barone, Legal Director at Coca-Cola Europacifics Partners, spoke on the subject of costs, highlighting the positive impact of litigation funding on the cash flow of litigation;
a topic of central importance was discussed by Amedeo della Croce, regarding a possible convergence between legal and economic aspects in the Litigation Funding instrument, emphasising the support offered by Litigation Funders in the management and verification of documents relating to litigation.

The presentations during the conference’s second panel were devoted to the contractual aspects of litigation funding, an engaging round-table discussion skilfully moderated by Luitgard Spogler, featuring experts such as Francesco Ghizzi, Ursula Claravolo, Niccolò Landi, and Alberto Odennino, who provided a detailed analysis of the models and types of policies and services currently available, presenting a number of practical case studies.

Finally, the third panel, skilfully moderated by Nicolò Manzini, focused on the similarities and differences between class actions and litigation funding.

Speakers on the topic included Mr Paolo Florio (Movimento Consumatori), Mr Francesco Marelli (RP Legal & Taxi) and Mr Giovanni Latorre (Chief Legal Officer at LexCapital), who discussed the models for class actions and their potential integration with supporting instruments that have long been present in foreign markets, such as Litigation Funding.

The event served as an important forum for discussion on a new and complex topic such as litigation funding and, more generally, on methods of managing litigation risk, enabling LexCapital to offer a unique perspective and concrete insights on this subject, which is currently undergoing significant adaptation and evolution within the Italian context.

A litigation fund

In Italy, the instrument of Litigation Funding is becoming increasingly widespread. This involves an entity, typically a Special Purpose Vehicle (SPV) or a Fund, that approaches the holder of a litigation right to support them in protecting their rights by bearing all expenses, including those due in the event of an unsuccessful outcome, or by making a purchase proposal.

This is also evident from the latest Global Antitrust Enforcement Report by Allen & Overy, which specifically records an increase in private enforcement actions within our territory. The article in Milano Finanza, in which we are cited, makes particular reference to actions for damages brought against banking institutions for the alleged manipulation of Euribor rates, but above all, to the agreement among corrugated cardboard manufacturers, which it describes as "...one of the largest cartels ever uncovered in Italy by the Antitrust Authority due to the number of companies involved (34) and the scale of the fines imposed."

Milan, 1 February 2024 – LexCapital, an innovative legal-tech start-up and benefit corporation operating as a litigation funder, announces the addition to the company of Lucca’s S.r.l., a holding company owned by the family of entrepreneur Luciano Lucca, founder and chairman of the Assiteca Group, a leading player in the insurance brokerage sector.

Lucca also took on the role of Chairman of LexCapital’s Board of Directors, which was enlarged from three to five members, with the addition of Elisabetta Vasco (independent), previously a senior manager of Banca Intesa Sanpaolo and of Ubi Banca. Marcello Gallo, Emilio Campanile and Maurizio Santacroce remain in post as Directors. Giuseppe Farchione remains in post as Chief Operating Officer.

Luciano Lucca started his career in the insurance sector in 1966 at Toro Assicurazioni before founding Verconsult, an insurance brokerage company, in 1972, and becoming its Managing Director. Following Verconsult’s move to the GPA group in 1975, Lucca took on prominent roles in GPA and in its subsidiary SAMA. His career underwent a further transformation in 1982 with the founding of HOWDEN ASSITECA, of which he became Managing Director and, subsequently, Chairman. In 2005, he was appointed Vice-President of the National Association of Insurance Brokers (ACB) and in 2010 he took over the presidency of EOS RISK España, one of the leading insurance brokerage companies in Spain.

Predictive Justice and Litigation Funding: the future of the start-up

According to LexCapital’s COO Giuseppe Farchione, “the new additions confirm the growth trajectory of LexCapital’s original project. The heart of the project remains our technology platform, LexCapital Litigation Assessment – LLA, in the field of Predictive Justice. An innovative tool, based on a statistical-mathematical model, which allows the investment opportunity to be assessed in advance, taking into account various parameters such as the defendant’s solvency, the probability of a favourable outcome and an estimate of the possible proceeds. It is an area that has enormous potential for development thanks to artificial intelligence. We know how costly and complex litigation can be in Italy: our Predictive Justice technology, designed to support and guide decisions, helps to minimise the risk of losing a case and the relative consequences”.

LexCapital’s experience

In its first eighteen months of operations, LexCapital has already assisted its client companies in litigation in the antitrust sector and has a substantial number of cases in the pipeline in other areas, such as reservations in public works, medical and professional damages and financial derivatives contracts.

All of which is done through litigation funding, an operation whereby a third party buys the chose in action and makes its financial resources and network of lawyers and specialist consultants available to those who wish to defend their rights in court, sharing in any proceeds and assuming all the financial risks.

The company has also initiated a pilot case comprising approximately fifty disputes in the Reverse Litigation Funding or Defence Side Litigation Funding segment on behalf of a leading insurance company.  A service that could be replicated and distributed throughout the same market to support other companies. The official announcement of a new partnership between independent national litigation funders, with LexCapital as promoter and co-founder, who will cooperate on cross-border projects and with regard to co-investment in larger litigation matters, is expected soon.

The Deloitte Legal team, composed of the lawyers Alessandra Gesino and Sandro Lamparelli, assisted Lucca’s S.r.l. in carrying out the due diligence and in negotiating the terms of the agreement to acquire an interest in and serve on the Board of LexCapital. Legal Tech Forum 2023 in Bologna: LexCapital as a Gold Sponsor

The Forum, which took place in Bologna on 29 November at the Cappella Farnese di Palazzo D’Accursio, is considered a leading light in the debate on technology in the legal world.

It focused in particular on the synergy between the law and technology.

LexCapital’s CIO Manuel Caccone gave a talk which focused in particular on the topic of “Litigation Funding and Predictive Justice“.

Legal Tech Forum 2023 in Bologna: an important conference on legal technologies

The event was promoted and coordinated by Legal Tech Italy.

An observatory – founded by the Bologna-based company Kopjira – which has been studying the legal-tech sector for many years and is concerned specifically with the interaction between the law and the numerous possibilities offered by new technologies.

Since 2015, Legal Tech Forum has been an unmissable event for those wishing to discuss developments in technology in the legal field.

A discussion which sees the active participation of influential guests – companies, start-ups, law firms and industry professionals – who bring their field experience and encourage debate on this cross-sectoral issue.

To date, the event has welcomed 2500 participants and more than 150 speakers, who have been invited to discuss how the spheres of law and new technologies can be combined.

The historic guests of Forum 2023

Now in its seventh year, the Legal Tech Forum has seen the participation of renowned speakers and leading companies over time.

Among these companies were Sky, Google, Mediaset, IBM and Cisco.

The event, after two years of being held remotely, was back open to visitors attending in person.

This decision was taken not only in order to appreciate the physical spaces symbolising the birth of the project, but also to encourage direct (in person) debate between the various professionals in the sector.

Many topics were discussed: Big Data, Cybersecurity, Metaverse, Blockchain and, of course, the new frontier of artificial intelligence, with its legal and regulatory aspects, and Predictive Justice.

The debate on legal technologies

The debate surrounding legal technologies is not merely technical, but also involves questions of ethics and morality.

As Tommaso Grotto – CEO and co-founder of Kopjira – pointed out, we are living in a historic time in which our interaction with new technologies is becoming more and more widespread and intrusive in every sector.

This leads to questions regarding the functional aspect of these tools – their correct use – and also regarding the related ethical and social issues.

Legal Tech Forum aspires to become the epicentre of debate on this issue and LexCapital is delighted to have been able to contribute its experience, professionalism, and vision.
