How does the purchase of a Litigious Right work?
LexCapital selects, evaluates, and potentially purchases for consideration the Litigious Right (Res Litigiosa) from any Subject holding it (Private individual, Company, Association, Public Entity), determining, on a case-by-case basis, to retain a specific percentage of the amount obtained as compensation at the end of the proceedings in the event of a victory or, otherwise, to bear all the costs of a potential loss.
LexCapital evaluates the purchase of litigious rights in all areas of Litigation, thanks to our technological platform (RischioLegale®) and a network of Lawyers and Technical Consultants highly specialized in the various matters subject to dispute.
No, LexCapital is also active in Reverse Litigation Funding or Defense Side Litigation Funding activities, acting in support of Defendants, typically Insurance Companies operating in Liability lines, Banks and Financial Intermediaries, and self-insured Healthcare Facilities, for an innovative management dedicated to the Run-off of Civil Litigation and Long-Tail Reserves.
Furthermore, we offer Business Information services for measuring Litigation Risk, protection tools such as policies covering the full Litigation Risk or only in the event of a potential loss, and Risk Assessment tools.

PROCESS TO FOLLOW FOR CASE EVALUATION
Submit your case to us Through the "Submit your case" button, you will be able to fill out the Contact Form, briefly describing the litigation that concerns you. Within a short time (max 72 hours), we will contact you for a quick examination of the information available and necessary to better evaluate the litigation.

Receive LexCapital's proposal The team of professionals completes the examination of the litigation, and LexCapital formulates the proposal to purchase the litigious right.
Purchase of the litigious right If you are satisfied with the proposal, we conclude the assignment of the litigious right; from now on, LexCapital will bear all legal and technical costs, also assuming any potential costs of an adverse judgment, for which you will not be asked for reimbursement. Only in the event of final success will LexCapital share, with a pre-agreed quota, in the economic benefit obtained by the assigning party.
PROCESSING OF THE INFORMATION AND DATA PROVIDED All information provided, including personal data concerning third parties, is processed fairly and in compliance with current legislation; personal data is collected, processed, and shared with third parties only for specific, legitimate reasons and to the extent deemed strictly necessary (for example, to estimate the probability of a successful outcome of the dispute).
