{"id":1396,"date":"2022-12-22T12:56:00","date_gmt":"2022-12-22T11:56:00","guid":{"rendered":"https:\/\/www.lexcapital.it\/public-procurement-under-the-meloni-government-the-reform\/"},"modified":"2024-05-06T13:57:40","modified_gmt":"2024-05-06T11:57:40","slug":"public-procurement-under-the-meloni-government-the-reform","status":"publish","type":"post","link":"https:\/\/www.lexcapital.it\/en\/public-procurement-under-the-meloni-government-the-reform\/","title":{"rendered":"Public procurement under the Meloni government: the reform"},"content":{"rendered":"\n<p>The<strong> Council of Ministers<\/strong> has approved <strong> decree reforming the Public Procurement Code<\/strong>.<\/p>\n\n<p>At present, the text has been <strong>approved in preliminary examination<\/strong> and the process will entail <strong>several steps<\/strong> before it is finally <strong>endorsed and published in the Official Gazette<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Public procurement reform under the Meloni government: two main principles<\/strong><\/h2>\n\n<p>Italy&#8217;s<strong> Prime Minster Giorgia Meloni<\/strong> presented it as<\/p>\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>an organic, balanced and visionary measure, the result of skilled and extensive work, which simplifies procedures and ensures faster timescales. It will also be a driving force behind the relaunch of economic growth and the modernisation of the nation&#8217;s infrastructure.<\/p>\n<\/blockquote>\n\n<p>It is, therefore, a measure aimed at <strong>streamlining and speeding up<\/strong> the entire system of public procurement, <strong>simplifying practices and expediting bureaucracy<\/strong>.<\/p>\n\n<p>The entire philosophy and vision of the reform can be summarised in two basic <strong><a href=\"https:\/\/www.ipsoa.it\/documents\/quotidiano\/2022\/12\/17\/appalti-pubblici-approvata-riforma-codice-contratti\">principles<\/a><\/strong>:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Result Principle<\/strong>: which prioritises the <strong>public interest<\/strong> and proposes measures to <strong>facilitate and simplify the process<\/strong> and thus render a smoother and leaner public procurement system, ensuring quality and speed on the one hand, and competition, legality and transparency on the other.<\/li>\n\n\n\n<li><strong>Trust<\/strong> is another fundamental principle, taking the form of <strong>transparency, legitimacy and fairness<\/strong> on the part of the public administration and finance officials.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>Public procurement reform under the Meloni government: the role of digitalisation<\/strong><\/h3>\n\n<p><a href=\"https:\/\/www.ilgiornale.it\/news\/interni\/codice-dei-contratti-pubblici-c-lok-consiglio-dei-ministri-2096592.html\">Digitalisation<\/a> is undoubtedly a <strong>driving force<\/strong> behind the mechanisms of the reform and a core component in coordinating its apparatus.<\/p>\n\n<p>It is one of the <strong>key objectives on the Italian political agenda<\/strong> and its relevance has been highlighted by all the <strong>bureaucratic and administrative shortcomings during the Covid 19<\/strong> pandemic.<\/p>\n\n<p>The decree attempts to build a &#8220;<strong>digital procurement ecosystem<\/strong>&#8220;, the main components of which are:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>National database<\/strong> of public procurement contracts<\/li>\n\n\n\n<li><strong>Virtual file<\/strong> of the economic operator<\/li>\n\n\n\n<li>Use of <strong>automated systems<\/strong> for the management of public procurement contracts<\/li>\n\n\n\n<li>Use of <strong>digital procurement platforms<\/strong>;<\/li>\n\n\n\n<li><strong>Complete digitalisation<\/strong> of all <strong> systems to access procedures concerning public procurement contracts<\/strong><\/li>\n\n\n\n<li>All citizens are granted the possibility, within the limits dictated by the regulations in force, to <strong>access tender documents<\/strong>. They are granted <strong>generalised civic access<\/strong> to said documents.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>More streamlined procedures<\/strong><\/h3>\n\n<p>The <strong>most interesting provisions<\/strong> of the Meloni decree include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>An <strong>ad hoc plan<\/strong> for what are deemed priority infrastructures will be included in the <strong>Economic and Financial Document (DEF)<\/strong>, following a discussion between the <strong>central government and the regions<\/strong>.<\/li>\n\n\n\n<li><strong>Reduction and streamlining of project timescales and processes<\/strong> and also the establishment by the Higher Council of Public Works of a special <strong>committee to evaluate and examine these projects.<\/strong><\/li>\n\n\n\n<li>Parallel evaluation of <strong>archaeological interest<\/strong><\/li>\n\n\n\n<li><strong>Some contracts will be subject to an executive plan:<\/strong> this will be based on a <strong>technical feasibility project<\/strong> submitted and then duly approved. This form of contract excludes all those <strong>contracts concerning ordinary maintenance works<\/strong>.<\/li>\n\n\n\n<li>The <strong>thresholds for direct awards<\/strong> and negotiated procedures of the so-called &#8220;<strong>Covid-19 simplification decree<\/strong>&#8221; remain in place.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\"><strong>Other measures envisaged by the Reform<\/strong><\/h3>\n\n<p><strong>Other measures<\/strong> are being taken to further simplify the <strong>public procurement system<\/strong>.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The figure of the &#8220;<strong>general contractor<\/strong>&#8221; has been reintroduced, with a view to <strong>achieving an administrative result<\/strong> by using specific <strong>professional and specialist services<\/strong> in exchange for a fee.<\/li>\n\n\n\n<li><strong>Incentives<\/strong> are envisaged for the participation of institutional investors in <strong>project tenders<\/strong>.<\/li>\n\n\n\n<li>The category of so-called &#8220;<strong>special sectors<\/strong>&#8221; is identified, based on the <strong>essential nature<\/strong> of the services provided (energy, water, transport, etc.).<\/li>\n\n\n\n<li>The reform provides for the <strong>lifting of the prohibition on so-called &#8220;cascade subcontracting&#8221;<\/strong>, (<a href=\"https:\/\/www.codiceappalti.it\/dlgs_50_2016\/art__105__subappalto\/8486#:~:text=19.,formare%20oggetto%20di%20ulteriore%20subappalto.\">art. 105<\/a>(19) of Legislative Decree 50\/2016, which states &#8220;The performance of the services subcontracted cannot be subject to further subcontracting&#8221;) \u2013 <strong>created to stem the infiltration of organised crime<\/strong> \u2013 already the subject of debate at EU level in infringement procedure No.<br\/>2018\/2273 of the<strong> European Commission<\/strong>, which<strong> threatened sanctions against Italy regarding the non-application of EU procurement regulations<\/strong>.<\/li>\n\n\n\n<li>With regard to <strong>awards without tenders<\/strong>, the obligation to contract \u2013 except for special sectors \u2013 between 50% and <strong>60% of the works<\/strong> is established.<\/li>\n\n\n\n<li>There is <strong>no provision<\/strong>, in the event of the compulsory winding-up of the economic operator following the award of the contract, <strong>for the natural expiration of the contract<\/strong>. This, subject to the authorisation of the bankruptcy judge, may be entered into with an <strong>administrator authorised to carry on the business<\/strong>.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\"><strong>Disputes<\/strong><\/h4>\n\n<p>With regard to <a href=\"https:\/\/www.lexcapital.it\/en\/litigation-funding-in-italy-justice-for-companies\/\">disputes<\/a>, <strong>ANAC&#8217;s (national anti-corruption authority) powers have been enhanced with <\/strong> respect to<strong> supervisory and disciplinary functions<\/strong>.<\/p>\n\n<p>The <strong>court<\/strong> may also <strong>claim damages<\/strong> against operators who, through <strong>unlawful actions<\/strong>, have conspired to <strong>distort and mislead the outcome of the tender<\/strong>.<\/p>\n\n<p><em>The image is taken from the ANSA agency photo archive, author Claudio Ferri<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Council of Ministers has approved decree reforming the Public Procurement Code.
