and litigation funding: an ever closer union in Europe and Italy"},"content":{"rendered":"\n<p>In our system, the biggest <strong>obstacle in the development of third party <a href=\"https:\/\/www.lexcapital.it\/en\/litigation-funding-in-italy-justice-for-companies\/\">litigation funding<\/a><\/strong> is the <strong>unpredictable<\/strong> (often particularly long) duration of proceedings, which makes it difficult to predict a likely <strong>return on investment<\/strong>.<\/p>\n\n<p>However, <strong>this phenomenon is also beginning to gain a foothold<\/strong> in our system, albeit with investments that currently are somewhat sporadic and not yet well established, with a few exceptions.<\/p>\n\n<p>In particular, new, <strong>purely national funds have begun to appear on the Italian market<\/strong>, focusing their activities on <strong>arbitration and domestic litigation<\/strong>.<\/p>\n\n<p>Italian <strong><a href=\"https:\/\/www.lexcapital.it\/en\/the-british-non-profit-litigation-funding-model-lexcapital-pioneer-on-the-italian-market\/\">litigation<\/a><\/strong> has, as in some other jurisdictions, <strong>considerable advantages<\/strong>: litigation costs are relatively low, a factor that in the context of third-party litigation funding is a definite advantage in <strong>terms of return on investment<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Antitrust and litigation funding: privileged sector<\/strong><\/h2>\n\n<p>In this context, one of the <strong>most important areas for litigation funding<\/strong> is the<strong> infringement of antitrust law<\/strong> and the related action for damages, for two reasons.<\/p>\n\n<p>The <strong>first<\/strong> lies in recent <strong>case law and regulatory interventions<\/strong> that have <strong>changed the landscape of antitrust litigation<\/strong>.<\/p>\n\n<p>As is well known, the <strong>introduction of the <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:1990-10-10;287\">Competition Law<\/a><\/strong> (Law No. 287 of 10 October 1990) has <strong>not significantly<\/strong> affected the volume of cases.<\/p>\n\n<p>In fact, the <strong>real development of litigation funding<\/strong> is due to the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/IT\/TXT\/PDF\/?uri=CELEX:61999CJ0453&amp;from=EN\">judgments<\/a> of the European Court of Justice of 20.9.2001, Case No. C453\/99, and of 13 July 2006, Case No. C-295\/04, which were followed by <a href=\"https:\/\/www.osservatoriosullefonti.it\/archivio-rubriche-2015\/fonti-dellunione-europea-e-internazionali\/1209-direttiva-2014104ue-regole-comuni-in-materia-di-azioni-basate-sul-diritto-nazionale-per-il-risarcimento-dei-danni-da-violazioni-del-diritto-antitrust-nazionale-ed-europeo#:~:text=Il%2026%20novembre%202014%20il,e%20dell%27Unione%20europea%E2%80%9D.\">Directive 2014\/104\/EU<\/a>, implemented In Italy through <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2017-01-19;3\">Legislative Decree. 3\/2017<\/a>, <strong>with regard to actions for damages resulting from anti-competitive activity<\/strong>.<\/p>\n\n<p>In the development of litigation and third party litigation funding, the <strong>role now played by the Italian Antitrust Authority, which is competent in this area<\/strong>, appears particularly relevant.<\/p>\n\n<p>Indeed, it was envisaged that the <strong>decision issued by the Authority<\/strong> would be <strong>binding on the national courts,<\/strong> although naturally <strong>subject to appeal before the administrative courts<\/strong>.<\/p>\n\n<p><strong>Prior to this<\/strong> regulatory change, the decision of the Antitrust Authority could <strong>only be considered an administrative act<\/strong>, which could be freely assessed by the ordinary court called upon to rule in a claim for damages and to therefore ascertain any unlawful conduct, thereby <strong>extending the duration of the proceedings<\/strong>.<\/p>\n\n<p>Evidently, the <strong>binding force of decisions of the Antitrust Authority,<\/strong> issued in the context of a <strong>less complex and less costly procedure<\/strong>, makes antitrust litigation particularly favourable for the development of the phenomenon of <strong>third party litigation funding<\/strong>.<\/p>\n\n<p>The second reason concerns the reform of class action lawsuits, provided for in Art. 140 bis of the <a href=\"https:\/\/www.brocardi.it\/codice-del-consumo\/parte-v\/titolo-ii\/art140bis.html\">Italian Consumer Code<\/a> and extensively amended by Law 31\/2019 which, by inserting Title VIII bis of Book IV into the Code of Civil Procedure, with Articles 840 bis et seq., <strong>extended standing to sue<\/strong> in class action proceedings also to non-consumers, albeit <strong>within the scope of business<br\/> activities<\/strong>, in order to <strong>protect individual homogeneous rights infringed by the actions or conduct of companies<\/strong> or bodies managing public services or utilities.<\/p>\n\n<h2 class=\"wp-block-heading\"><strong>Antitrust: the legislation<\/strong><\/h2>\n\n<p>The <strong>legislation<\/strong> must obviously be <strong>interpreted in conjunction with the antitrust rules<\/strong> and, in particular, with the rules on the burden of proof, which is lighter in antitrust cartel cases since there is a system of simple presumptions as to the damage and the causal link between said damage and the damaging conduct, although proof to the contrary is admissible.<\/p>\n\n<p>Although there is no significant activity before the Antitrust Authority for the time being, the <strong>introduction of class actions into our legal system has allowed an embryonic development of third party litigation funding<\/strong> in class actions for damages suffered due to cartel cases.<\/p>\n\n<p>Indeed, the <strong>initiation of class actions, directed by specialised litigation funds<\/strong>, suing for damages caused by <strong>antitrust violations<\/strong> can be observed in the domestic market following the Antitrust Authority&#8217;s decisions.<\/p>\n\n<p>A well-known and particularly recent case is that of the <a href=\"https:\/\/libra.claims\/casi\/cartello-italiano-del-cartone-ondulato\/#:~:text=Trenta%20delle%20imprese%20condannate%20con,venticinque%20ricorsi%20presentati%20dai%20cartellisti.\">Antitrust Authority&#8217;s decision No. 27849 of 2019<\/a>, which <strong>sanctioned several companies for having &#8220;put in place an agreement that is by object restrictive of competition<\/strong> contrary to Article 101 TFEU, consisting of a single and complex cartel continued over time aimed at strongly distorting the competitive dynamics in the <strong>market for the production and <br\/>marketing of corrugated cardboard sheets<\/strong>.<\/p>\n\n<p>A <strong>large number of companies are involved in the Authority&#8217;s decision<\/strong>, which also includes some leniency applicants, and the <strong>penalties issued against them are very high<\/strong>.<\/p>\n\n<p>There is, therefore, a <strong>clear symbiosis between the role played by the Antitrust Authority and that of private enforcement<\/strong>, highly incentivised by the new procedural measures provided for by the <strong>recent legislative changes<\/strong>.<\/p>\n\n<p>The <strong>result<\/strong> is, in fact, an <strong>increase in the deterrent value<\/strong> of the action for damages, which reinforces the measure, <strong>ultimately binding<\/strong> on the trial court, issued by the administrative authority.<\/p>\n\n<p>All these aspects <strong>confirm the Antitrust sector as an ideal area for the development of third party litigation
