LexCapital<\/strong><\/a>is proud to have participated<\/strong>, as a speaker at the Conference on <\/a>\u00a0Sustaining Access to Justice in Europe<\/strong>, held on 19 – 20 October<\/strong>.<\/p>\n\n

Organised by the Erasmus University<\/a> Rotterdam<\/strong>, and in particular by the NWO team of the Vici Project Access to Justice<\/strong>, the event is one of the most interesting, internationally, on the topic of access to justice<\/strong>.<\/p>\n\n

Key figures<\/strong> from the worlds of politics, academia and business, together with consumer associations from Europe, the USA and Asia, discussed problems and developments concerning access to justice in Europe<\/strong>.<\/p>\n\n

In particular, how it is facilitated by new forms of litigation funding<\/strong>.<\/p>\n\n

Conference on Sustaining Access to Justice in Europe: the event<\/h2>\n\n

The event, held in the form of a symposium<\/strong>, was attended by influential figures from civil society and the intellectual world<\/strong>, also dedicated to exploring new forms of litigation funding<\/strong>.<\/p>\n\n

Particular attention<\/strong> was paid to forms such as Crowdfunding<\/strong>, third-party support<\/strong> in litigation (Litigation Funding<\/a>) and Class Actions.<\/p>\n\n

The main topic of debate?<\/strong><\/p>\n\n

Improving the mechanisms for access to civil justice<\/strong>, with the aim of making the process smoother and fairer<\/strong>.<\/p>\n\n

Our COO, Giuseppe Farchione<\/strong>, took part in the panel \u201cAltruistic Ventures: Balance, Profitability and Social Impact \u2013 Myth or Reality\u201d<\/strong>, to discuss the right balance to be pursued<\/strong>, also in Litigation Funding, between profitability and a positive social impact<\/strong>, in parallel with traditional \u201cfor profit\u201d activities.<\/p>\n\n

The basic question<\/strong> is whether litigation driven by fair and altruistic goals<\/strong>, in today’s society, is a fact or mere utopia<\/strong>.<\/p>\n\n

Access to Justice in Europe<\/h3>\n\n

The topic of facilitating Access to Justice<\/strong> in Europe is widely debated<\/strong>.<\/p>\n\n

Access to the court system<\/strong>, without particular obstacles and limitations, is the only avenue open to citizens wishing to assert their rights<\/strong>.<\/p>\n\n

However, in Europe<\/strong>, government cutbacks and the exorbitant costs of court proceedings<\/strong> have made access to certain avenues of justice increasingly unequal<\/strong>.<\/p>\n\n

In this context, financial (and organisational) support<\/strong> has shifted from the public to the private sphere<\/strong>, making it possible for companies and citizens to seek support from third parties<\/strong>, through Social Impact Litigation Funding<\/strong>.<\/p>\n\n

LexCapital<\/strong>, which, since its recent launch<\/strong>, has been dedicated to improving the justice mechanism<\/strong> through its Litigation Funding<\/strong> activity, was delighted to bring its experience to the Conference on Sustaining Access to Justice in Europe.<\/p>\n\n

At the event, we focused in particular on two aspects<\/strong>: Civil Rights and Litigation Funding<\/strong> and Support for Non-Profit Organisations<\/strong> by Litigation Funders.<\/p>\n\n
